Tips, Tricks, and Traps of Donating Closely Held Businesses to Tax-Exempt Entities

Tips, Tricks, and Traps of Donating Closely Held Businesses to Tax-Exempt Entities will feature a presentation by Kelly Hellmuth, JD.

Program Description:

Many business owners today seek to plan for both succession and philanthropy. These business owners may wish to give the bulk of a business to a charity or social welfare organization but may not realize the complexity of the rules applicable to exempt organizations. In particular, these gifts typically implicate the rules on excess business holdings which have certain useful exceptions.

This presentation will examine the various options for holding business interests in exempt organizations, such as donor advised funds, private foundations, supporting organizations, and 501(c)(4) organizations, and the planning opportunities and tax implications of each option including excise taxes and ways to avoid them.
